COUNCIL PERSONS present:
Others present for the meeting were: Bob Muirhead – Midwest Energy; Daniel Erdman – 2504 Ave E property owner; Alan Rush – Ellsworth County Independent/Reporter; Theresa Staudinger – City Attorney; Ted Soukup – City Superintendent; Bob Doepp – Wilson Police Chief; and Susan Kriley – City Clerk.
CALL TO ORDER-
Mayor Larry Ptacek called the Regular Meeting of the Wilson City Council to order on Monday, August 7, 2017 at 7:00 p.m.
Lorie Taylor made a motion to approve the August 7, 2017 agenda with addition. Gary Everett seconded the motion and it carried.
Cindy Heinze made a motion to approve the July 17, 2017 regular meeting minutes. Gary Everett seconded the motion and it carried.
BILLS AND PAYROLL-
Gary Everett made a motion to approve the August 7, 2017 bills in the amount of $36,619.69 and August 1, 2017 payroll in the amount of $11,876.73. Cindy Heinze seconded the motion and it carried.
ORDINANCE NO. 839- MIDWEST ENERGY FRANCHISE TAX RENEWAL-
Bob Muirhead, Midwest Energy representative, was present to answer questions or concerns from the Council on the franchise tax renewal proposal since the current one expires Nov 2017 – proposal is for a franchise fee of 5% for a 20 year term. Cindy Heinze made a motion to adopt Ordinance No. 840- Midwest Energy Franchise Tax Renewal. Lorie Taylor seconded the motion and it carried.
7:07 p.m. Bob Muirhead left the meeting.
CZECH FESTIVAL COMMITTEE UPDATE-
Kate Schiermeyer and Susan Kriley, Czech Festival Co-Chairs, gave an feedback update on the 2017 Czech Festival. There was a good turn out for the 2017 Czech Festival with good comments heard on the activities and events. The feedback meeting was held with a lot of input and with the addition of more committee members for the 2018 Czech Festival. The committee has secured one band and started on the 2018 Czech Festival planning. The Mayor and Council thanked the committee for their hard work.
BOARD OF HEALTH- 2504 AVE E- PICTURE ROCKS LTD- DANIEL ERDMAN, PRESIDENT-
The Mayor and Council acknowledged that Daniel Erdman has installed the required fence around the hazardous area. Daniel Erdman, 2504 Ave E property owner, gave a report regarding his efforts in trying to repair his building and stated that most of the work done can not be seen from the outside. Cindy Heinze made a motion to give Daniel Erdman until the Monday, August 21, 2017 City Council meeting to provide a list of the work that has been done to stabilize, work to be done to finish stabilizing and repair, and a timeline for the work to be done. Information requested must be evaluated and presented by an Engineer in addition to Daniel Erdman. Steve Claussen seconded the motion and it carried.
7:33 p.m. Daniel Erdman left the meeting.
2018 BUDGET HEARING:
2018 BUDGET HEARING-
No public comments received. Cindy Heinze made a motion to approve the 2018 Budget. Gary Everett seconded the motion and it carried.
CITY SUPERINTENDENT WITH TED SOUKUP-
- Set up and tore down – Czech Festival
- Streets were chipped and sealed by Circle C
- Hunter Estates – started project on Aug 1, 2017- they will work on sewer first
CITY CLERK WITH SUSAN KRILEY-
- Susan will attend a Pictometry training session in Ellsworth on Aug 8, 2017
POLICE CHIEF WITH BOB DOEPP-
- Presented July 2017 activities
- No issues during Czech Festival
- Received a bid from Axon Enterprises, Inc. on 2 new tasers (current taser is about 10 years old with a service life of only 5 years) – Cindy Heinze made a motion to table a decision until the Aug 21, 2017 Council meeting. Steve Claussen seconded the motion and it carried.
Gary Everett made a motion to allow the Wilson Fire Department to apply for the Kansas Fire (KFRSG) Grant for a washing machine and bunker gear. Cindy Heinze seconded the motion and it carried.
EXECUTIVE SESSION FOR NON-ELECTED PERSONNEL-
Gary Everett made a motion to enter into Executive Session at 7:45 p.m. for non-elected personnel for 5 minutes to include the City Attorney Theresa Staudinger. Cindy Heinze seconded the motion and it carried.
Gary Everett made a motion to return to open session at 7:50 p.m. Cindy Heinze seconded the motion and it carried.
No action was taken.
CITY ATTORNEY UPDATE WITH THERESA STAUDINGER-
Theresa Staudinger informed the Council that people can record the meeting but the Council can restrict it to be reasonable and unobtrusive.
HUNTER ESTATES DEVELOPMENT-
Hunter Estates development (infrastructure) Phase I – Reported in Dept
ORDINANCE NO. 840 – TRANSIENT GUEST TAX
Mayor Larry Ptacek reported the Melinda Merrill, owner of the Midland Railroad Hotel, has been involved with the development of the Transient Guest Tax and ordinance. Currently, Midland Railroad Hotel is the only business affected by the tax and the tax will be .25%. Lorie Taylor made a motion to adopt Ordinance No. 840- Transient Guest Tax. Darcy Hubka-Vopat seconded the motion and it carried.
REFUSE WAIVER FOR 608 31ST-
Cindy Heinze made a motion to approve the refuse waiver for 608 31st – rental owned by Linda Bushnell and currently vacant- to be reinstated when rented. Lorie Taylor seconded the motion and it carried.
