at Wilson City Hall

Others present for the Public Hearing and Regular Meeting were:  Keegan Bailey – North
Central Regional Planning Commission;  Alan Rusch – Ellsworth County Independent/Reporter; 
Lexie Rusch – guest; Theresa Staudinger – City Attorney (via phone);  Josh Tipton – Police Chief;  Jonathan Lawrence – Patrol Officer; and Susan Kriley – City Clerk.

 

CALL TO ORDER-

Mayor Mike Peschka called the Regular Meeting of the Wilson City Council to order on Monday, July 20, 2020 at 7:02 p.m.

 

APPROVE AGENDA-

Chuck Crawford made a motion to approve the July 20, 2020 agenda with additions.  Darcy Hubka Vopat seconded the motion and it
carried.

 

MINUTES-

Darcy Hubka Vopat made a motion to approve the July 6, 2020 Public Hearing minutes
and Regular Meeting minutes.  David Criswell seconded the motion and it carried.

 

PUBLIC HEARING:

PUBLIC HEARING FOR KDOC
HOUSING REHABILITATION AND DEMOLITION GRANT -

Keegan Bailey, grant administrator with North Central Regional Planning Commission, reviewed
the KDOC Housing Rehabilitation and Demolition Grant application details.  The total grant request is for $311,750 that
would allow for eight homes to be rehabilitated ($25,000 maximum per house) and
four demolitions.  The total match is $6,750 ($3,000 City - $500 administration grant writing and $2,500 environmentals plus
$3,750 to be paid by landlords for rental rehabilitations).  There was no public input.  The public hearing was closed.

 

UNFINISHED BUSINESS:

KDOC HOUSING REHABILITATION AND DEMOLITION GRANT-

Darcy Hubka Vopat made a motion to approve Resolution 7-2020 to apply for the KDOC
Housing Rehabilitation and Demolition Grant and the grant documents.  David Criswell seconded the motion and it
carried.

 

7:15 p.m. Keegan Bailey left the meeting.

 

REPORTS:

BILLS, PAYROLL, AND TRANSFERS–

Cindy Heinze made a motion to approve the July 20, 2020 bills for $36,661.25; July 16, 2020
payroll for $9,595.03; and transfers for 2nd Quarter 2020 from Water to Water Repair $7,087.60;  from Water to Capital Improvement $4,725.07;  from Sewer to Capital Improvement $5,262.91; from Sewer to Sewer Reserve $12,280.12;  and from Water to General $3,843.00.  Darcy Hubka Vopat seconded the motion.

 

BOARD OF HEALTH UPDATES AND SUMMARY –

3006 Ave F – vehicles

The City had two remaining vehicles hauled away that were still inoperable and on the property.

 

2115 Ave C –

Josh Tipton provided progress pictures.  The deadline
for all noted Board of Health violations to be removed was July 10, 2020.  The City will schedule a contractor to remove
the violations noted and the Board of Health will notify the property owner of the date.

 

2211 Ave E –

Progress is being made regarding the shed- items have been removed out of the shed.

 

809-815 24th–

The Board of Health reviewed the case on July 10, 2020. 
The violations noted on the original Board of Health violation list have been satisfied.

 

415-417 28th–

The resolution was published on July 16, 2020 and will be published the second time on July
23, 2020.  Josh Tipton will serve the resolution to the property owner this week.

 

2211 Ave D –

Property owner met with World Pest Control regarding the bats.

 

308 26th –

Progress is being made.

 

7:43 p.m. Theresa Staudinger joined the meeting.

 

FENCES AROUND SWIMMING POOLS –

Currently, the City does not have an ordinance requiring fences around swimming pools.  Theresa Staudinger stated that any liability
is on the property owner.

 

 

 

UNFINISHED BUSINESS:

ABANDONED BUILDING PROPOSED ORDINANCE-

David Criswell made a motion to approve Ordinance No. 854 pertaining to abandoned
buildings.  Chuck Crawford seconded the motion and it carried.

 

HOUSING PROJECT-

No new information.

 

KDOC CDBG CV ECONOMIC DEVELOPMENT GRANT-

Businesses have until August 14, 2020 to submit an application to the City of Wilson.  All applications will be reviewed with the
available grant money divided among all the applicants.  Rules and guidelines by the state have been
changed.

 

MAINTENANCE SUPERINTENDENT POSITION-

EXECUTIVE SESSION-

Cindy Heinze made a motion to enter
executive session for non elected personnel to discuss the Maintenance
Superintendent position to include the City Attorney Theresa Staudinger and to
return to open session in Wilson City Hall at 8:13 p.m.  Ryan Stoppel seconded the motion and it
carried.

 

Cindy Heinze made a motion to return to open session at 8:13 p.m. David Criswell seconded
the motion and it carried.

 

Chuck Crawford made a motion to set the pay range for the Superintendent at $17.00 - $25.00 and Assistant Superintendent at $14.50 - $22.00.  Ryan Stoppel seconded the motion and it carried.

 

DEPARTMENTS:

CITY CLERK UPDATE WITH SUSAN KRILEY-

·   Darcy Hubka Vopat made a motion to accept the Employee Handbook updates - Employee
Benefits section.  Chuck Crawford seconded the motion and it carried.

·        
Provided the Financial Report, Budget Report, and Income Received Report.

·        
At the August 3, 2020 Council meeting, the Council will need to approve the Budget
Summary for an August 17, 2020 Budget Hearing.

 

POLICE CHIEF UPDATE WITH JOSHUA TIPTON-

·   Emergency Planning Committee has been communicating via email

·  Chuck Crawford made a motion to approve the City to pay for three uniform shirts for
Jonathan Lawrence for $121.00 from Robinson Printing.  Cindy Heinze seconded the motion and it
carried.

·   Working with storm spotters

·   Emergency Preparedness Trailer – working on organizing and updating



MAYOR/COUNCIL-

Council-
Chuck Crawfordreported that there have been dogs running at large.  The police are addressing the issue and have
been asking the public to call in to report them when they are seen running at large.

 

Darcy Hubka Vopat made a motion to hire LD Stoughton Backhoe Service $85.00 per hour to
haul 15-16 tons of red shale from More Excavating in Viola, KS for an approximate total of $510.00.  David
Criswell seconded the motion and it carried.  Darcy Hubka Vopat made a motion to purchase 15-16 tons of red shale from
More Excavating for $18.00 per ton.  Cindy Heinze seconded the motion and it carried.
 

Darcy Hubka Vopat proposed to move a trash can from Ave E to the Egg Park.  The Chamber is aware of this request.


9:00 p.m. Alan Rusch left the meeting.

 

Darcy Hubka Vopat made a motion to approve for Tyler Denham to use the north ballfield on
Saturday August 15, 2020 for a ball tournament for $75.00 and to waive the alcohol restriction.  Cindy Heinze
seconded the motion and it carried.

 

David Criswell reported that the water tower work started today.

 

Chuck Crawford presented some suggested handbook policies.  Cindy Heinze made a motion to table the matter until the next
meeting.  David Criswell seconded the motion and it carried.

 

Chuck Crawford revisited the possibility of double chip and seal Ave D from 31st to 33rd
and 31st from Ave D to Ave E for an estimated cost of $27,000.  If the City isn’t able to do that at this
time, he suggested laying down the rock that the City already owns.  There was no decision made at this meeting.

 

Ryan Stoppel made a motion to remove Evan Just from the fire department due to
relocation.  Darcy Hubka Vopat seconded the motion and it carried.

 

9:32 p.m. Jonathan Lawrence left the meeting.

 

BOARD OF HEALTH-

EXECUTIVE SESSION-

Cindy Heinze made a motion to enter executive session for possible acquisition of real estate in the City of Wilson
to include the City Attorney Theresa Staudinger and to return to open session in Wilson City Hall at 9:42 p.m.  Ryan
Stoppel seconded the motion and it carried.

 

Darcy Hubka Vopat made a motion to extend the executive session until 9:52 p.m. Ryan Stoppel seconded the motion and it carried.

 

Cindy Heinze made a motion to return to open session at 9:52 p.m. Chuck Crawford seconded the motion and it carried.

 

Chuck Crawford made a motion to offer Picture Rocks Ltd Daniel Erdman $15,000 for 2504 Ave E and 2411 Ave E and if a purchase agreement is not reached by August 17, 2020, a resolution will be passed to proceed with the removal and repairs of the Board of Health violations.  Cindy Heinze seconded the motion and it carried.
